Other Information: The Council seeks proposals for the operation, maintenance, and possible development of Basildon Golf Course. Please note that the Council is seeking an operator to take over full operation and maintenance of Basildon Golf Course rather than individual components, although interested parties may themselves wish to form a consortia to take advantage of individual specialisms. Interested parties will be evaluated initially on the basis of a qualification questionnaire and, thereafter, the proposals they submit. Both the qualification questionnaire and the proposals must be submitted by the date and time set out above. No late questionnaires or proposals will be accepted.

Interested parties should also note that the Council has set out several key principles for this opportunity, including that the services should be provided at nil cost to the Council. Although the Council will consider other proposals, those proposals that are at nil cost to the Council will be evaluated more favourably. While this opportunity is not subject to the Public Services (Social Value) Act 2012, the Council has considered how this contract might improve the economic, social and environmental well-being of the Borough and will seek to demonstrate this through this process. The Council considers that the community nature of the asset, the regeneration aspect of the opportunity, and the scale of the opportunity means that there could be significant benefits to the Borough. Interested parties should be prepared to demonstrate how opportunies associated with the delivery will be made known and available to individuals and businesses in the Borough and how benefits could be delivered to the community.

The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.

The Transfer of Undertakings (Protection of Employment) Regulations 2006 ("TUPE") may apply to this contract and there may be staff that could transfer from the existing golf course operator to an incoming provider. Interested parties must seek independent advice regarding the application of TUPE (and with regard to all aspects of this opportunity and any resulting contractual arrangements).

The Council reserves the right to discontinue this process, in whole or in part, at any time with or without award. The Council will not be responsible for any costs, fees, or expenses incurred, or any other money paid or payable, by anyone submitting proposals.
